Terms of Service

These terms are provided as general information about how Bethel Therapy delivers its services. They are not legal advice. Please have a qualified Australian legal practitioner review and tailor this document before you publish it.

These Terms of Service set out the basis on which Bethel Therapy (“we”, “us”, “our”) provides specialist behaviour support and social counselling, and on which you may use this website. By engaging our services or using this site, you agree to these terms.

1. Not an emergency or crisis service

Bethel Therapy does not provide emergency, crisis or after-hours acute care. Our website and any material on it is general information only and is not a substitute for individual professional advice, assessment or treatment.

If you or someone else is in immediate danger, call 000.

For crisis support, contact Lifeline on 13 11 14, the Suicide Call Back Service on 1300 659 467, or 13YARN on 13 92 76. These services operate 24 hours a day.

2. Our services

We provide specialist positive behaviour support and social counselling to people of all ages, working alongside participants, families, carers and support networks. Services may include functional behaviour assessment, interim and comprehensive behaviour support plans, proactive and response strategies, carer and staff training, counselling sessions, and collaboration with other providers.

The specific services we will provide, their frequency and their cost are agreed with you in a separate service agreement before support begins. Where there is any inconsistency between these terms and your signed service agreement, your service agreement prevails.

3. Eligibility and referrals

We accept referrals from participants, families, nominees, guardians, support coordinators, health professionals and other providers. Accepting a referral does not create an obligation to provide services. We will assess whether our services are appropriate for your needs, whether we have capacity, and whether we hold the necessary expertise.

If we are not the right fit, we will tell you and, where we can, suggest alternative options.

4. NDIS participants and fees

For NDIS participants, our services are delivered and charged consistently with the current NDIS Pricing Arrangements and Price Limits. Fees, travel charges and any cancellation terms are set out in your service agreement.

You are responsible for ensuring your NDIS plan holds sufficient funds for the agreed supports, and for telling us promptly if your plan, plan management arrangements or nominee details change. Where funding is unavailable, exhausted or a claim is rejected, you may be responsible for the cost of services already delivered.

5. Appointments and cancellations

We ask that you give as much notice as possible if you need to change or cancel an appointment. Short-notice cancellations and non-attendance may be charged in accordance with the NDIS Pricing Arrangements and the cancellation terms in your service agreement.

We may need to reschedule where a practitioner is unwell or unavailable, or where attending would be unsafe. We will give you as much notice as we reasonably can and will not charge you for a session we cancel.

6. Your responsibilities

To help us support you safely and effectively, we ask that you:

  • Provide accurate and complete information about needs, health and circumstances
  • Tell us about any risks to the safety of the participant, others or our practitioners
  • Provide a safe, respectful environment for sessions, including in home visits
  • Treat our practitioners with courtesy and respect
  • Tell us promptly about changes to contact details, NDIS plans or support arrangements
  • Work with us on agreed strategies and let us know when something is not working

We may suspend or end services where there is a serious risk to safety, where there is aggression or harassment toward our staff, or where the therapeutic relationship can no longer be maintained. Wherever possible we will discuss this with you first and support a considered transition to another provider.

7. Confidentiality and its limits

What you share with us is treated confidentially and handled in accordance with our Privacy Policy. However, confidentiality is not absolute. We may need to disclose information without your consent where:

  • There is a serious and imminent risk to the life, health or safety of any person
  • We are required to report suspected abuse, neglect or harm to a child or vulnerable person
  • A reportable incident or restrictive practice must be notified to the NDIS Quality and Safeguards Commission
  • We are compelled by a court order, subpoena or other legal obligation

Where we can do so safely and lawfully, we will tell you before information is disclosed.

8. Records

We keep clinical and administrative records as required by law and by our professional and NDIS obligations. You may request access to your records and ask for corrections as described in our Privacy Policy.

9. Intellectual property

All content on this website — including text, graphics, logos, illustrations and layout — is owned by Bethel Therapy or used under licence, and is protected by Australian copyright law. You may view and print content for your own personal or internal use. You may not reproduce, adapt or republish it commercially without our written permission.

Assessment tools, support plans and reports we prepare remain our intellectual property. You are, of course, free to use and share the plans and reports we prepare for you with your support network and other providers.

10. Website use

You agree not to use this website in any way that is unlawful, or that could damage, disable or impair it. We take reasonable care to keep information on this site accurate and current, but we do not warrant that it is complete or error-free, and it may change without notice.

Our site may link to third-party websites for convenience. We are not responsible for the content, accuracy or privacy practices of those sites.

11. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law where doing so would be unlawful.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be supplied with due care and skill. To the extent the law permits us to limit our liability, our liability for a failure to comply with a consumer guarantee is limited to resupplying the services or paying the cost of having them resupplied.

Subject to the above, we are not liable for indirect or consequential loss, and we are not liable for outcomes that depend on factors outside our control, including the actions of third parties or a participant’s or family’s decision not to follow agreed strategies.

12. Feedback and complaints

We welcome feedback and take complaints seriously. Raising a concern will never affect the quality of support you receive. Please contact us and we will acknowledge your complaint and work with you to resolve it.

13. Changes to these terms

We may update these terms from time to time. The current version will always be available on this page with the date it was last updated. Where a change materially affects services we are already providing to you, we will discuss it with you.

14. Governing law

These terms are governed by the laws of the State of Queensland, Australia. You and Bethel Therapy submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.
